Family Law terms:
- Best Interest of the
Children - The Ohio statutes and
the courts use this standard to determine
how the divorcing couple will each receive
parenting time with the children. It is of
utmost importance that the child be
minimally affected by the divorce.
- Marital Property - The
Ohio statute outlines the definition of
pre-marital, marital and non-marital
property. Marital property is the assets
acquired during the marriage jointly or
individually by either party.
Without a Pre-Nuptial Agreement
and depending on the source of the funds
used, an asset will likely be marital
property if purchased after the wedding.
For instance, a business or company started
by one spouse during the marriage will
likely be marital for purposes of property
split and valuing assets during the divorce.
- Non-Marital Property - This
is property acquired during the marriage
with non marital funds, as from a separate
trust fund set up for just that person by
his or her family, etc. Another case of this
type could be the result of a Pre-Nuptial
agreement that accepts certain property
purchased during the marriage as non
marital.
- Pre-Marital Property - This
is easily identified as the assets owned by
either party PRIOR to the wedding. It
can also be identified in a Pre-Nuptial
Agreement if one is signed prior to the
marriage ceremony.
