If your family does not have at least a will, your survivors upon your death will have a difficult time to probate your estate through the local county Probate Court Superior. You may want to consider a Living Trust, which is now available to everyone, regardless of your economic status or your family’s net worth. The Living Trust is a very simple document that will avoid the Probate of your Estate and pass all of your Estate immediately on to your beneficiaries, spouse, children, relatives, etc. In the Trust you can spell out specifically your wishes to gift certain items to various people and make sure that your assets are distributed according to your wishes. Many clients are now opting for the more flexible Living Trust than the old “Last Will & Testament.” This avoids probate expenses and delays.
